These general Terms and Conditions govern the use of the ESA Web Site and its entire range of products and services available online.

The European Society of Anaesthesiology is, hereinafter, referred interchangeably with the ‘ESA’. The ESA Web Site refers to the website of the European Society of Anaesthesiology: www.esahq.org. These General Terms and Conditions govern the use of the ESA Web Site (www.esahq.org) and its entire range of products and services available online.

The ESA Web Site is owned and operated by the European Society of Anaesthesiology; its registered office is located at the address mentioned below. The ESA Web site is in English, which is the official language for external ESA communications.

By using the ESA Web Site, you agree to comply with these Terms and Conditions. Please read them carefully as they contain important and legal information with regard to the ESA Web Site. They imply rights and obligations from and to the ESA. For certain products and services, specific terms may apply. When applicable, the ESA may complement these Terms & Conditions with specific Rules & Regulations posted at the product or service web location. In the event of any conflict or inconsistency the latter shall prevail.

The ESA reserves the right to amend these Terms & Conditions at its sole discretion, without prior notice, with the proviso that details of the amendments are published on the ESA Web Site. The ESA Web Site hosts a number of links to external websites. In providing these links, the ESA does not endorse the content, the products, services or viewpoints expressed by these external websites. The ESA Web Site Terms and Conditions no longer apply when you leave the ESA Web Site. The terms and conditions of the linked site then apply.

Creating a website profile (website user account)

Creating a website profile (user account) is required to access personal services online and certain online content. The user is responsible for maintaining the confidentiality of his/her account login details. The user profile is unique and personal. It should not be shared with anyone.

The ESA shall not be held responsible for unauthorised use of the user’s account by a third party to whom the user may have, intentionally or not, disclosed his/her account login details.

Contractual Regulations

These General Online Sales Conditions govern all online sales, between the European Society of Anaesthesiology and the purchaser, concerning products and/or services ordered on the ESA Web Site.

These conditions are subject to change at any time and without prior notice, provided that details of all amendments are published on the ESA Web Site.

By ordering products and/or services on the ESA Web Site, you agree to these General Online Sales Conditions and any specific terms (‘Rules & Regulations’) which may complement these conditions.

Prior to validating your order online, please read these Conditions carefully as well as the Rules & Regulations posted on the service or product ordering page.

The ESA reserves the right to refuse to accept your order if the ESA finds that you are in breach of these Terms & Conditions.

Note that some extras (e.g. Accompanying Person, access to Networking Evening or similar events) that can be bought when registering or after registration for a congress (e.g. Euroanaesthesia) will be invoiced by ESAACS (ESA Administration & Conference Services SPRL-SFS), the PCO (Professional Congress Organiser) of the European Society of Anaesthesiology (ESA).

For technical reasons and convenience, payment for these extras is however transacted through ESA (along with the congress registration fee, or separately, if extras are purchased in an order subsequent to the registration). ESA will thus be the sole seller mentioned in any communication with the purchasing party, other than the invoice for such extras, which will mention ESAACS as seller.

Products & Services

Services offered online offer the possibility to acquire certain products and services such as registration to exams, congresses and meetings organised by the ESA.

The ESA reserves the right to change or remove particular ordering methods without prior notice. Changes in the ordering procedure will be posted on the product or service page. Products & Services are available for order whilst they are posted on the ESA Web Site and/or during the ordering period specified.

Online Sales Conditions

Product & Service Pricing Policy

Products and services sold online may be purchased in Euros only.

Except where otherwise mentioned, the price displayed for each product or service is inclusive of tax (VAT included).

For a specific product, several different pricings may apply depending upon various components such as the date of purchase (e.g. early fees for congress registration).

The ESA reserves the right to modify its product & service pricing at any time, although products/services will be billed according to the price applicable when the order was submitted by the purchaser.

Product & Service Characteristics

The ESA attempts to be as accurate as possible in the description of product and/or services characteristics available on the ESA Web Site. However, the ESA does not warrant that online descriptions are error-free and/or 100% accurate. The ESA is not contractually bound by these descriptions. Any decision taken by the purchaser, based on product/service characteristics, is the purchaser’s sole responsibility.

Ordering Process – General Rules

Language

The ESA ordering process is in English, which is the official communication language of the ESA.

Ordering Process

  • To order online ESA products or services, the purchaser is required to have created a website profile and to log in.
  • Use of any online application on this website to order ESA products or services constitutes acceptance of the General Terms & Conditions, and, if applicable, of the Rules & Regulations.
  • Once logged in, the purchaser chooses the product or service to order and follows the ordering steps
  • The first step is the confirmation of address details and selection of the various elements of the product/service offer. The total price is then calculated based on the selections and is in euros only.
  • The second step is the review and acceptance of the order by the purchaser (pricing, invoicing addresses,…). At this stage, most of the order elements are still changeable.
  • The final step is the capture in secured mode of the payment details. By providing his/her payment details and submitting the order at the end of this step, the purchaser gives authorisation to process the order.
  • Upon submission of the order, an order number is automatically attributed to the current order. At this stage, the order is no longer modifiable nor cancellable online by the purchaser. For any subsequent changes to the order the purchaser needs to contact the ESA directly. Specific terms may apply depending upon the product/service. These are outlined in the Rules and Regulations specific to the product/service, if applicable.

Upon completion and submission of the order, an email is sent to the purchaser with the following information:

  • Identity of the Seller (ESA)
  • Order Reference and date
  • Ogone Payment Reference
  • Charging method
  • Product/service description
  • Total Pricing

This acknowledgment is not an acknowledgment of order. It simply confirms that the ESA has received the order and will process in a timely manner, based on the information provided by the purchaser at the time of the order.

Should there be any differences between the order placed online and the information contained in this acknowledgment, please inform the ESA immediately at info@esahq.org. The product/service and the Order Number should be quoted in the request.

Processing of Order

  • Upon validation of the order by the ESA, a confirmation is sent by email to the purchaser to confirm that the order and payment have been processed by the ESA.
    The confirmation may include any changes which may have occurred due to non-availability of the original products/services selected or due to other factors.

Payment

  • Online orders are payable via Credit Cards (AMEX, Visa, EuroCard/Master Card) and in Euros only.

Invoice

  • An invoice is automatically sent to the purchaser in a second email.

Order Cancellation

For products/services – such as, but not limited to, congresses and meetings – specific cancellation conditions apply. The Rules & Regulations for these product/services include the cancellation conditions.

Acceptance of the Online Sales Conditions

By ordering products and/or services on the ESA Web Site, you agree to these General Online Sales Conditions and any specific terms (‘Rules & Regulations’) that may complement these conditions.

Prior to submitting your order online, please read these conditions carefully as well as the Rules & Regulations posted at the service or product ordering page, or relevant web section.

The information stored by the ESA will stand as proof of all the transactions and financial operations related to the order.

Unavailability/Force Majeure

In the event of industrial disruption or other unforeseen circumstances, the ESA accepts no responsibility for loss of moneys incurred by the purchaser and/or by the recipient of the product/service bought.

The ESA disclaims all responsibilities for the unavailability of the ESA Web Site due to unexpected conditions.

Arbitration Clause

Any disputes arising out of or in connection with online sales or to these Terms & Conditions shall be brought before court and will be governed and analysed according to Belgian law, based on their merits, independently of the rules concerning conflicting legislation.

Legal Jurisdiction and Applicable Law
